Michelle Harton (and michellehartonart.com) offerings Fine Art Paintings, Commissioned Paintings, Reproductions and other products or services

RIGHTS TO ARTWORK AND IMAGES

All artwork, images, and graphics are the sole property of Michelle Harton and may not be used by any third party without written permission.  

Copying or reproducing artwork created by Michelle Harton (as seen on michellehartonart.com or elsewhere) is strictly prohibited without written permission from the artist.  

• Michelle Harton retains all rights to all artwork until it has been purchased by a private or public collector at which time the collector receives the right to display the artwork in their home or business.

• Michelle Harton retains all rights to the image of all artwork including the rights to the image of sold & commissioned original paintings.

• Michelle Harton retains the right to make REPRODUCTIONS OF ANY AND ALL ARTWORK CREATED BY Michelle Harton UNLESS THE COLLECTOR HAS PURCHASED THE FULL OR PARTIAL RIGHTS TO THE ARTWORK by prior agreement in addition to purchasing the original painting.

• If you own an original painting and would like to discuss purchasing further rights, displaying the work in a public space, or nullify my right to reproduce, please contact michelleharton@yahoo.co.uk

COLLECTORS OF REPRODUCTIONS HAVE THE RIGHT TO DISPLAY THE ARTWORK IN THEIR HOME OR BUSINESS BUT RETAIN NO OTHER RIGHTS TO THE ARTWORK.

Any image of the interior which includes the artwork in a 3rd party publication (such as social media, magazine, newspaper or book) must come with attribution (artwork title, artists name).

All other uses must be agreed to in advance in writing.

ELECTRONIC COMMUNICATIONS

Visiting michellehartonart.com or sending emails to Michelle Harton constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

YOUR ACCOUNT

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Michelle Harton is not responsible for third party access to your account that results from theft or misappropriation of your account. Michelle Harton and associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

Cancellations / Refund Policy / Customs 

Cancellations

Orders must be cancelled within 24 hours before they are in transit for delivery through the contact form   or by email michelleharton@yahoo.co.uk

Returns

I want you to be fully happy with your new artwork so if a painting is not as you expect, you have 14 days to contact me by email and request a refund. Once a return has been agreed, you are responsible for packing the painting securely and the cost of return delivery. Once the piece has been safely returned and the painting is in exactly the same condition it left the studio you will receive your refund.

All work is very carefully packaged to arrive with you safely. If you receive an artwork that has been damaged in transit, please contact me within 7 days with a photograph of the damage.

Customs Duties

Orders that are shipped to countries outside the Europe Union may be subject to import taxes, customs duties, and fees levied by the destination country. The recipient of an international shipment subject to such import taxes, customs duties, and fees (which are levied once a shipment reaches your country) must comply with them and I cannot be held liable whatsoever. Additional charges for customs clearance must be borne by the recipient. I have no control over these charges and cannot predict what they may be. Customs policies vary from country to country, so please contact your local customs office for further information. When customs clearance procedures are required, unfortunately it can cause delays beyond my original delivery estimates.

The Linked Sites are not under the control of Michelle Harton and Michelle Harton is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Michelle Harton is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Michelle Harton of the site or any association with its operators.

Certain services made available via michellehartonart.com are delivered by third party sites and organizations. By using any product, service or functionality originating from the michellehartonart.com domain, you hereby acknowledge and consent that Michelle Harton may share such information and data with any third party with whom Michelle Hartton has a contractual relationship to provide the requested product, service or functionality on behalf of michellehartonart.com users and customers.

Michelle Harton content is not for resale. International Users

Michelle Harton (and michelleharton.com) is controlled, operated and administered by Michelle Harton from her studio within Ireland. If you access the site from a location outside Ireland, you are responsible for compliance with all local laws. You agree that you will not use the Michelle Harton content accessed through michellehartonart.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Liability Disclaimer

This site isn’t perfect. Nor are we, the studio team or Michelle Harton. There may be inaccuracies, errors, typographical mistakes, and all sorts of messes on this website and in the studio content in general. We reserve the right to change all of it — the whole website. Every word.

Michelle Harton shall not be held liable for any direct, indirect, incidental, special, or consequential damages caused by this website, WordPress, WooCommerce, or any third party. If you are not happy with this website, you don’t have to use it.

SECURITY

Payment information is not retained by michellehartonart.com and we take precautions to protect your information during this process. When you submit sensitive information via the website, your information is protected both online and offline.

Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way through a Payment Processing System (Stripe or Paypal, depending on your preference at checkout).
